Some would argue that the Health Care Reform bill was the major consequence of Barack Obama, but I think this is.
It’s one thing to ram a bad bill down the throats of the American People, but then to be able to stack the deck at the Supreme Court to enforce the bad law that is the real consequence. True, John Paul Stevens is 90 years old and is already the leader of the liberal faction of the Supreme Court, so I don’t think any replacement Obama sends to the Senate for confirmation will change the existing balance of conservatives vs liberal judges.
However, let’s assume that Obama nominates a 50 year old man or woman to fill the seat. Based on Stevens history, that means the person could be sitting on the High Court for up to 40 years. That’s a long time and it could seem longer if other judges retire before the end of Obama’s first term.
The thing that scares me the most is that rather nominating a quiet, unassuming judge like Stevens who though liberal was at least thoughful, Obama will nominate an activist judge that will work long and hard to subvert the Constitution in anyway possible.
I could be wrong, but one thing’s for sure: he will not nominate another Justice Roberts, Thomas, or Scalia.
